Terms and conditions

Article 1 – Scope

1.1 These general terms and conditions apply to all offers, orders, and agreements made with M-up Collective.
1.2 By placing an order or accepting an offer, you agree to these terms and conditions.
1.3 Deviations from these terms are only valid if agreed upon in writing. All other provisions remain unaffected.
1.4 Any rights granted to M-up Collective under these terms also apply to any third parties involved by M-up Collective in the execution of services.

Article 2 – Offers & Agreements

2.1 An agreement is only binding once M-up Collective has confirmed your order.
2.2 We reserve the right to decline an order or apply specific conditions to delivery. If your order is not accepted, you will be notified within five (5) working days.

Article 3 – Prices & Payments

3.1 All prices are listed in euros (€). In accordance with Belgian VAT regulations, VAT is not charged on second-hand items under the margin scheme. Import duties and taxes (for deliveries outside the EU) are the responsibility of the customer.
3.2 Payment methods include Bancontact, PayPal, credit card, and direct bank transfer.
3.3 Orders will only be processed once payment is received in full. If payment is not completed within the given time frame, M-up Collective reserves the right to cancel the order.

Article 4 – Shipping, Delivery & Returns

4.1 We ship worldwide.
4.2 Orders within Belgium and Europe are shipped via trusted couriers such as bpost, PostNL, or DHL. You may also collect your purchase from our office by appointment.
4.3 We aim to dispatch orders within 24 to 48 hours after receiving payment.
4.4 Estimated delivery times:
– Europe: 2–5 business days
– Outside Europe: 5–10 business days
Delivery times may vary; M-up Collective cannot be held responsible for courier delays.
4.5 A tracking number will be provided once your order has been shipped.
4.6 Customs duties and import taxes are not included in the purchase price and must be covered by the buyer. Please check your country’s import regulations if you are ordering from outside the EU.
4.7 If an item is no longer available after you place an order, we will inform you the same day. Orders placed over the weekend are shipped on the next working day (usually Monday).
4.8 Returns are not accepted. All items are pre-owned and sold “as-is.” If you have questions before purchasing, we’re happy to provide more details or arrange a private viewing by appointment.

Article 5 – Retention of Ownership

5.1 Ownership of an item transfers only once full payment has been received. However, the risk passes to the buyer at the time of delivery.

Article 6 – Intellectual Property

6.1 All intellectual and industrial property rights related to the products sold remain with the original brand or rights holder.
6.2 M-up Collective does not guarantee that the items sold do not infringe upon any intellectual property rights of third parties.

Article 7 – Authenticity Guarantee

7.1 M-up Collective guarantees that all items have been authenticated and meet industry standards for second-hand luxury goods.
7.2 Should you have doubts about the authenticity of an item, you may contact us. Upon request, we can have the item re-authenticated by a certified third party. Costs incurred for this service are the responsibility of the customer.

Article 8 – Force Majeure

8.1 In the event of force majeure, M-up Collective reserves the right to postpone or cancel your order without compensation.
8.2 Force majeure includes, but is not limited to: war, natural disasters, pandemics, strikes, disruptions in transport, or other circumstances beyond our control.

Article 9 – Communication & Notices

9.1 You are responsible for providing correct contact details. All communications will be sent to the address or email you provided during checkout, unless otherwise stated in writing.

Article 10 – Applicable Law & Dispute Resolution

10.1 All agreements are governed exclusively by Belgian law.
10.2 In case of disputes, the courts of the judicial district where M-up Collective is registered (Antwerp) have exclusive jurisdiction.

Article 11 – Copyright & Use of Content

11.1 All photos, texts, and visual content on the M-up Collective website are protected by copyright. Reproduction, duplication, or distribution without express written permission is strictly prohibited.
